Terms of Service

Last updated October 15, 2026

1. Agreement

These Terms govern your use of the Haggler Shop website, apps and services (the "Service"), operated by Haggler Shop ("we", "us"). By creating an account, signing in (including with Google, Microsoft or Facebook) or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

  • You must be at least 18 years old and able to enter into a binding contract.
  • You must give accurate information and keep it up to date.
  • You are responsible for everything that happens under your account. Keep your password and sign-in methods secure and tell us promptly at support@haggler.shop if you suspect unauthorised use.
  • One person, one account, unless we agree otherwise in writing.

3. We are a marketplace

Haggler Shop lets sellers list items and buyers make offers and buy them. Unless we clearly say otherwise, we are not the buyer or seller of any item and we do not own, inspect, store or take possession of items. The contract of sale is between the buyer and the seller.

Sellers are solely responsible for their listings, including that items are lawful to sell, are accurately described, and are delivered or handed over as agreed. Buyers are responsible for reading listings carefully and paying for what they buy.

4. AI features

The Service uses artificial intelligence ("AI") throughout. Depending on your settings, AI may, among other things: identify items from photos; estimate resale values and suggest or set prices; write or publish listings; negotiate with buyers on a seller's behalf, including making counter-offers and accepting offers within the limits the seller has set; screen and redact messages; and propose or apply outcomes for returns and disputes.

AI output may be wrong. AI can misidentify an item, misjudge its condition, authenticity or value, set a price that is too high or too low, misunderstand a message, make an unfavourable counter-offer, accept an offer you would not have accepted yourself, or reach a wrong conclusion about a return, a dispute or another user. AI output can be incomplete, outdated or inconsistent, and it can sound confident when it is wrong.

By using AI features you understand and agree that:

  • AI output is provided for convenience and information only. It is not professional advice, an appraisal, an authentication, a guarantee of value, or a statement of fact by us, and it is not a substitute for your own judgement.
  • You are responsible for reviewing anything the AI produces for you, such as listings, prices and descriptions, before relying on it, and for the settings you choose (for example your minimum price, how hard the AI negotiates, auto-listing and automatic returns).
  • Actions the AI takes within your settings are taken on your behalf and bind you as if you had taken them yourself, including an offer the AI accepts at or above the minimum price you set.
  • Some AI decisions are spot-checked by people, but we do not review every AI action and we do not promise that any particular AI output will be reviewed or corrected.
  • AI-proposed outcomes for returns or disputes are suggestions. Where these Terms or our policies give you a right to a human decision or to escalate, using AI does not take that right away.
  • If you connect your own AI provider key, you are responsible for that provider's charges and terms, and we are not responsible for that provider's output or availability.
  • To the fullest extent permitted by law, we make no warranty that AI output is accurate, complete, reliable or fit for any purpose, and we are not liable for any loss arising from reliance on AI output or from actions the AI takes within your settings, including lost profit, a sale at a lower price, a missed sale, or a wrong decision about you or another user. This is subject to Section 14.

If you believe an AI decision about you was wrong, contact us at support@haggler.shop and we will look at it.

5. Listings and prohibited items

You may not list or sell anything that is illegal, stolen, counterfeit, recalled, hazardous, or that infringes someone else's rights, or anything we prohibit in our policies. We may remove listings and suspend accounts that break these rules, with or without notice.

6. Offers and negotiation

An offer that is accepted, by the other party or by AI acting on a seller's behalf, forms a binding agreement to buy and sell at that price, subject to checkout and payment. Do not make offers you do not intend to honour. Arranging to complete a sale outside the Service, or sharing contact details to do so, is not allowed.

7. Payments, fees and payouts

  • Payments are processed by Stripe. Sellers receive payouts through Stripe Connect and must accept Stripe's terms, including the Stripe Connected Account Agreement.
  • We charge sellers a platform fee on each sale at the rate shown in the Service, which we may change on notice. Shipping labels bought through the Service are charged to the seller's card or deducted from payouts as shown at the time.
  • We may hold, delay, reverse or offset payouts where needed for returns, refunds, disputes, chargebacks, suspected fraud, or to recover amounts you owe us.
  • You are responsible for any taxes on your sales and purchases.

8. Shipping, pickup, returns and disputes

Sellers must ship or hand over items within the time shown. Buyers and sellers must follow the return policy shown on the listing and our return and dispute process. We may decide disputes using the information available to us, and our decision on how funds held by us are released is final as between you and us, without limiting any legal rights you have against the other party.

9. Your content and ratings

You keep ownership of the photos, text and ratings you post. You give us a worldwide, non-exclusive, royalty-free licence to host, use, adapt, display and share that content to run, promote and improve the Service, including to train and evaluate the AI features. Ratings and reviews must be honest and based on a real transaction.

10. Things you must not do

  • Break the law, defraud anyone, or harass, threaten or discriminate against other users.
  • Avoid fees by taking a sale off the Service.
  • Manipulate prices, ratings, the AI negotiator or other AI features, for example with prompt injection.
  • Scrape, overload, reverse-engineer or interfere with the Service or its security.
  • Use another person's account or payment method without permission.

11. Third-party services

The Service relies on third parties, such as payment processors, carriers, sign-in providers and AI providers. Their services are governed by their own terms, and we are not responsible for them.

12. Suspension and closing your account

We may suspend or close your account if you break these Terms, if we have to by law, or to protect other users or the Service. You can close your account at any time. See how to delete your data. Sections that by their nature should survive, including 4, 9, 13, 14 and 15, survive closure.

13. Disclaimers

The Service, including all AI features, is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or the quality, safety, legality or description of any item, or that any user will complete a transaction.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service, AI output, items or other users, even if we were told such damages were possible. Our total liability for all claims related to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose and (b) US$100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer.

15. Indemnity

You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your listings, your transactions, your content, or your breach of these Terms or the law.

16. Governing law, changes and contact

These Terms are governed by the laws of [STATE/COUNTRY], and the courts of [STATE/COUNTRY] have exclusive jurisdiction, except where the law of your place of residence gives you the right to bring a claim locally.

We may change these Terms. If a change is material we will tell you, for example by email or in the Service, before it takes effect. Continuing to use the Service after that means you accept the change.
